1. General Provisions
These Terms of Service (hereinafter — "Terms") govern the use of the rodovod.ru website and services (hereinafter — "Service") provided by IP Pinashin V.S. (INN: 471605764182, OGRNIP: 324470400120471) (hereinafter — "Operator"). These Terms constitute a public offer in accordance with Article 437 of the Civil Code of the Russian Federation. By accessing and using the Service, you accept these Terms in full.
2. Description of Service
The Service provides an online platform for creating, editing, and storing genealogical (family) trees. The Service includes a free tier with limited features and paid subscription plans with extended capabilities. The Service is provided electronically via the Internet. The result of the service is provided immediately upon activation of the subscription.
3. User Accounts
To use the Service, you must register an account by providing accurate and complete information including your name and email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify the Operator of any unauthorized use of your account.
4. User Content
You retain all rights to the family tree data and content you create using the Service. You are solely responsible for the accuracy and legality of the information you enter. By using the Service, you grant the Operator a limited license to store and process your data solely for the purpose of providing the Service, in accordance with Federal Law No. 152-FZ "On Personal Data".
5. Subscription Plans and Pricing
The Service offers the following subscription plans: Free (up to 10 nodes) — 0 ₽/month, Basic (up to 50 nodes) — 290 ₽/month, Premium (up to 200 nodes) — 590 ₽/month, Unlimited (unlimited nodes) — 990 ₽/month. All prices are indicated in Russian rubles and include applicable taxes. The Operator reserves the right to change prices with at least 30 days' prior notice to users.
6. Payment Procedure
Payment is processed via T-Bank (JSC "T-Bank") using bank cards (Visa, Mastercard, Mir). Recurring payments are charged monthly on the subscription start date. The Operator does not store bank card details. Payment processing is carried out in accordance with the rules of international payment systems and the requirements of Federal Law No. 161-FZ "On the National Payment System".
7. Subscription Expiration
Upon expiration of a paid subscription, there is a 7-day grace period during which you retain access to your current plan features. After the grace period, your account reverts to the Free plan. Your data is preserved, but you cannot add new nodes beyond the free limit until you renew your subscription.
8. Right of Withdrawal and Refunds
In accordance with Article 26.1 of the Law of the Russian Federation "On Protection of Consumer Rights" and Government Decree No. 612, you may cancel a subscription and request a refund within 14 days of purchase, provided the service has not been fully consumed. To request a refund, contact rodovod.tree@gmail.com. Refunds are processed within 10 business days to the original payment method.
9. Prohibited Use
You may not use the Service: for any purpose that violates the laws of the Russian Federation; to harass, defame, or harm others; to upload malicious, illegal, or infringing content; to attempt unauthorized access to the Service systems or other users' data. The Operator reserves the right to suspend or terminate accounts that violate these Terms without prior notice.
10. Intellectual Property
All intellectual property rights related to the Service (design, code, trademarks, logos) belong to the Operator and are protected by the Civil Code of the Russian Federation (Part IV). Users may not copy, modify, distribute, or create derivative works based on the Service without the Operator's written consent.
11. Personal Data
The Operator processes personal data in accordance with Federal Law No. 152-FZ "On Personal Data" and the Privacy Policy available at rodovod.ru/privacy. By accepting these Terms, you consent to the processing of your personal data as described in the Privacy Policy.
12. Limitation of Liability
The Service is provided "as is" in accordance with Article 1064 of the Civil Code of the Russian Federation. The Operator shall not be liable for: any indirect, incidental, special, or consequential damages; data loss caused by circumstances beyond the Operator's control; temporary unavailability of the Service due to technical maintenance. The Operator's total liability shall not exceed the amount paid by the user for the last month of service.
13. Dispute Resolution
All disputes arising from these Terms shall be resolved through negotiations. The mandatory pre-trial claim procedure applies: claims must be sent to rodovod.tree@gmail.com and will be reviewed within 30 days. If a dispute cannot be resolved amicably, it shall be referred to the court at the Operator's location in accordance with the legislation of the Russian Federation.
14. Changes to Terms
The Operator reserves the right to modify these Terms at any time. The updated Terms will be published on this page with an updated "Last updated" date. Users will be notified of material changes via email. Continued use of the Service after changes constitutes acceptance of the new Terms.
